The South Carolina Mechanic’s lien statute creates a lien in favor of anyone “to whom a debt is due for labor performed or furnished or for materials furnished and actually used in the erection, alteration, or repair of a building or structure upon real estate or the boring or equipping of wells.”
This includes a vast array of potential lien claimants:
- General contractor
- Trade subcontractors
- Material suppliers
- Equipment rental companies
- Architects ( including both design and contract administration services)
- Engineers
- Surveyors
- Licensed commercial real estate brokers
- Private security guards at the site of the project
- Landscape services exceeding $5,000
- Anyone providing construction and demolition disposal services
The language of the South Carolina statute is very broad and virtually anyone who has provided work or materials for a construction project has the right to file a mechanic’s lien against the Owner’s real property.
